Tour Terms & Conditions
Carefully read all Terms & Conditions of this Tour.
Payment of any deposit to Always Travels, LLC for the Celebration of Central Europe: Budapest & Vienna small group tour from June 21 through June 28, 2020 (hereinafter the "Tour") constitutes acceptance of these terms and conditions on behalf of the person making the payment, as well as any Traveler or Travelers who have signed the Always Travels Participant Consent form.

The Traveler or Travelers who purchase this tour package or who have signed the Always Travels Participant Consent form (hereinafter Traveler or Travelers) hereby acknowledge that Travelers are voluntarily participating in a Tour organized by Always Travels LLC (hereinafter the Operator) or its suppliers and agree to be bound by the following Terms & Conditions.
Tour Prices
Tour prices include only those items and activities listed in the "inclusions" section of the Celebration of Central Europe: Budapest & Vienna tour description (available at www.alwaystravel.com). All items listed in the "exclusions" section of the tour description--including but not limited to, airfare, baggage fees, airport transfers, food, alcohol, or personal expenses not expressly listed as an "inclusion"--are not covered by the tour price. The price quoted on the tour page is quoted per person, based on two Travelers sharing accommodations and participating in the tour together. The total cost of the tour per Traveler couple is twice the quoted per person rate. Any Traveler wishing to participate as a solo traveler must pay a single supplement to cover the full costs of accommodations and other related tour expenses that cannot be divided. Prices are subject to change, prior to submission of the Travelers' deposit, without notice, according to the fluctuations of the euro, expiration of discounts, or the needs of the Operator. Once a Traveler makes a deposit, however, the final price of the tour, at the time of deposit for that Traveler, will be guaranteed.

Payments
An initial deposit payment is required to reserve a Traveler's place on the Celebration of Central Europe: Budapest & Vienna tour (June 21 - 28, 2020), organized by the Operator. Because it is used for securing services related to this tour on the Traveler(s) behalf, the deposit is non-refundable for any reason. The Travelers are required also to make payment of the remainder of the tour balance in three installments, as outlined in the "Payment Schedule" below. Final payment of the full tour price is due to the Operator no later than May 1, 2020. Failure to make a final payment by that date may result in the Travelers' places on the tour being offered to another paying customer and the deposit being forfeited.
Cancellations and Refunds
Any Travelers who submits written notice of their withdrawal from the Tour prior to May 1, 2020, will be refunded any money paid to the Operator for this specific tour, less the $250 non-refundable deposit. Any notice of withdrawal or cancellation made by the Traveler(s) after May 1, 2020 is not subject to refund. Exceptions to this cancellation policy cannot be made for any reason, including personal emergencies. There is no refund for leaving the tour early or arriving late. There are no refunds for any part of the program from which the Traveler(s) choose to opt out.
The Operator reserves the right to cancel the Tour prior to May 15, 2020, in which case all monies paid to the Operator will be refunded in full, including the deposit. If the Tour is cancelled, the Operator and its partners assume no liability for expenses Traveler(s) may have paid to any other supplier, including but not limited to airlines, carriers, transportation companies, or other tour operators.

Travel Insurance
The Operator strongly recommends that Travelers purchase travel insurance. Always Travels LLC does not provide travel insurance in any form. Prior to payment of the deposit, each Traveler will be required to acknowledge, as part of the Traveler Consent Form, whether or not the Traveler chooses to purchase travel insurance. The Operator accepts no responsibility or liability relating to Travelers' choice of, or purchase from, any seller of Travel Insurance, nor does the Operator accept responsibility for a Traveler’s choice not to purchase travel insurance protection.

Itinerary
The Operator reserves the right to make partial changes to the stated itinerary as may be required by our suppliers, or for other reasons. The Operator will do its best to keep changes to a minimum. Any changes or substitutions will result in comparable service for the Travelers' money or, in extreme cases, a partial refund to the Traveler, should a comparable substitute not be available. Determinations regarding substitutions or partial refunds resulting from changes to the itinerary are at the sole discretion of the Operator.
Photo Release
By participating in this Tour, each Traveler agrees to be photographed as part of group activities or programming related to the Tour, and grants the Operator (Always Travels LLC) permission to use such photos of its choosing in brochures, publicity, website advertising, or other marketing for Always Travels LLC, without compensation to the Traveler. Each participating Traveler also consents to have any such photos shared, at the sole discretion of the Operator, with other Travelers participating in this Tour. The consent to share photos with other participating Travelers extends solely to those Travelers' personal use; it does NOT grant Travelers who are not employed by the Operator any license to use the photos, or their derivatives, for commercial purposes.

Waiver: Release and Assumption of Risk
Travelers acknowledge that the Operator relies in part on others to provide overnight accommodations, personal tours, meals, and transportation. The Operator, while exercising reasonable care in selecting such premises and independent suppliers for the Tour, makes no guarantee without limitation to their suitability or performance, and assumes no liability for the failures, errors, or harm that may result from actions or inaction by such premises or independent suppliers.
By submitting payment to Always Travels LLP, Travelers further herein acknowledge and agree to release, absolve, indemnify and hold harmless the Operator, its owners, organizers, sponsors, partners, and employees from any injury or loss caused by or resulting from the leased accommodations or the engagement of any and all independent suppliers, unless such injury or loss resulted from the gross negligence of the Operator in selecting such premises or engaging such party or parties. This Agreement shall also serve as a release and assumption of risk from Travelers’ heirs, executors, administrators, and all members of Travelers’ families. Each Traveler, having carefully read this Agreement, understands that Travelers are releasing certain legal rights that Travelers otherwise have and Travelers enter into this Agreement freely and voluntarily. Travelers understand the Operator, in accepting Travelers’ participation in the Tour, does so based on this representation.
The Travelers and the Operator further hereby (a) irrevocably and unconditionally submit to the jurisdiction of the courts of the District of Columbia and to the jurisdiction of the United States District Court for the District of Columbia for the purpose of any suit, action or other proceeding arising out of or based upon this Agreement, (b) agree not to commence any suit, action or other proceeding arising out of or based upon this Agreement except in the courts of the District of Columbia or the United States District Court for the District of Columbia, and (c) hereby waive, and agree not to assert, by way of motion, as a defense, or otherwise, in any such suit, action or proceeding, any claim that it is not subject personally to the jurisdiction of the above-named courts, that its property is exempt or immune from attachment or execution, that the suit, action or proceeding is brought in an inconvenient forum, that the venue of the suit, action or proceeding is improper or that this Agreement or the subject matter hereof may not be enforced in or by such court.

Payment Schedule:

An initial Deposit of $250 per person is required to reserve places in the tour. If the Travelers qualify for any discounts, those discounts will be applied to the final payment, not the deposit.

Payment of the remainder of the tour price will be invoiced in three installments. The first installment will be due on or before February 1, 2020. The second installment will be due on or before March 15, 2020. The final payment of the total remaining balance will be due in full no later than May 1, 2020. (Any Traveler making an initial payment after February 1, 2020 will receive a revised invoice schedule.)

Each Traveler or pair of Travelers will receive an invoice for payment that will be delivered via email at least 2 weeks prior to the invoice due date.

Failure to pay the full amount by the due date may result in your space being sold to someone else, without refund of your initial deposit. Travelers are welcome to submit interim payments of in excess of the invoiced amount prior to the full amount of the Tour coming due. Late payments made after May 1, 2020, provided space is still available, will be subject to a 10% penalty on the outstanding balance of the bill.

Payment with Credit Card
Credit card payments may be made online via the link provided through this website or via Always Travels LLC's dedicated PayPal account.
Payment with Check
Personal checks will be accepted only with prior approval and consent of Always Travels LLC. To request permission to pay by check, please contact in writing at info@alwaystravels.com. Any initial deposit made by check will only reserve a spot upon the check’s clearance. Final payment by check must be received by the due date, or your spot in the tour may be cancelled without refund of the deposit.
